How we collect it. We collect information:

2. How We Use Information

We use personal information to:

We collect and use health information only as needed to provide the Services you request, or as you otherwise consent. We do not sell personal information, health information, genetic information, or samples. We do not use your information for targeted advertising. We do not use your identifiable test results to train artificial intelligence models.

3. How We Share Information

We share personal information only as described below.

4. Data Security and Retention

Security. We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information, appropriate to its sensitivity. These include encryption in transit and at rest and role-based access controls. No system is completely secure, and we cannot guarantee that unauthorized access will never occur. If a breach affects your information, we will notify you as required by law.

Retention. We keep personal information only as long as needed for the purposes in this Policy, to meet legal and contractual obligations, and to resolve disputes. Laboratories keep samples under their own policies and legal requirements. When information is no longer needed, we delete it or de-identify it.

5. Your Privacy Rights

Depending on where you live, you may have the right to:

How to make a request. Email legal@athletebloodtest.com or write to the address in Section 10. We will verify your identity before acting on your request. You may use an authorized agent, who must show your written permission. We will respond within the time the law requires. We will not discriminate against you for exercising your rights.

Appeals. If we deny your request, you may appeal by replying to our decision or emailing legal@athletebloodtest.com with “Privacy Appeal” in the subject line. We will tell you the result in writing.

Team clients. If you are tested through an Organizational Client, that organization may also hold your information under its own policies. Requests about records the team keeps should go to the team. We will help as required by law and our agreement with the team.

6. Health Information and HIPAA

The laws that protect your health information depend on how you use our Services.

Direct-to-athlete services. When you buy testing from us directly, ABT generally is not a HIPAA covered entity or business associate. Your information is protected by this Policy and other applicable federal and state health, genetic, and consumer privacy laws. We may voluntarily apply safeguards aligned with the HIPAA Security Rule. That voluntary choice does not make HIPAA apply.

Services for HIPAA covered entities. When a team physician practice, clinic, or other HIPAA covered entity engages us, we may act as its business associate. We use and disclose protected health information only as HIPAA and our business associate agreement allow. That covered entity’s Notice of Privacy Practices explains your HIPAA rights, and requests should go to it.

Services for other organizations. Many sports teams receive health information as employers, and HIPAA generally does not apply to them. We protect that information under this Policy, our agreement with the team, and applicable law, including federal and state genetic privacy laws.

Some state laws give health information extra protection. We treat all health and genetic information as sensitive.

7. Genetic Privacy Notice

Plain-language summary. Genetic testing is optional. ABT does not perform genetic testing. We arrange it through a third-party genetic testing provider(s), which analyzes your DNA and handles your genetic data under their own privacy policies. We order a genetic test only with your separate, express consent. With this consent, we may receive your genetic results and incorporate them into your blood test analysis and Reports. We never sell genetic information or samples. You can withdraw consent or ask us to delete the genetic information we hold at any time.

Collection and consent. We order genetic testing and receive genetic information from our genetic testing provider only after you give express consent for the specific test. Consent is never inferred from inaction or from accepting our Terms and Conditions. Our genetic testing provider may also ask for your consent under its own policies. We ask for separate express consent before:

Use. We use genetic information only to provide the test and Reports you requested, including incorporating your genetic results into your blood test analysis, and for any other purpose you expressly consent to.

Disclosure. We disclose identifiable genetic information only to you, to our genetic testing provider and the licensed health professionals or genetic counselors involved in providing the service, and to others you expressly authorize.

Access and deletion. You may access the genetic information we hold in the Portal. You may ask us to delete your account and the genetic information we hold. If you revoke consent, we will stop using your genetic information for the revoked purpose. Our genetic testing provider holds the genetic data it generates under its own privacy policy. To access or delete that data, contact the provider directly, or ask us and we will forward your request.

Samples. ABT does not store samples. If you ask us to, we will send the Laboratory or genetic testing provider a written request to destroy your sample. Their policies and legal requirements govern whether and when they do so.

Research. We will not use your genetic information for research without your express consent. Any research we conduct using de-identified data will follow applicable federal standards for protecting human research participants. Our genetic testing provider’s research practices are described in its privacy policy.

Security and retention. Genetic information receives the protections described in Section 4.

Complaints. You may file a complaint by emailing legal@athletebloodtest.com.
